Indian Bar Association Appeals All High Court & Supreme Court Judges to Protest Against Unlawful Activities of CJI Chandrachud
Recently, the Indian Bar Association (IBA) has appealed to all High Court and Supreme Court judges to protest against the unlawful activities of Chief Justice of India (CJI) Shri. D.Y. Chandrachud. In a 130-page letter, the IBA has pointed out various instances where the CJI has acted contrary to the law and against the law laid down by the larger benches of the Supreme Court.
The IBA has also accused the CJI of attacking the independence of High Courts and contempt of binding precedents of the Supreme Court. The association claims that the CJI has violated the fundamental rights of Supreme Court and High Court judges, including Justice G.S. Singhvi of Supreme Court and Justice Abhijit Gangopadhyay of Calcutta High Court.
One of the primary grievances of the IBA is that CJI Chandrachud had acted against binding precedents in not taking action of contempt against Abhishek Banerjee and Advocate A.M. Singhvi for making allegations of malafides on affidavit against a High Court judge for his judicial orders. Instead of taking action against Advocate A.M. Singhvi, CJI Chandrachud had passed an order of withdrawal of the case from the Bench of Justice Abhijit Gangapadhyay without hearing the said judge. This action by CJI Chandrachud is having a demoralizing effect on the said judge.
The IBA has expressed concern that the actions of CJI Chandrachud are undermining the rule of law and damaging the faith of the public in the judiciary. The association has appealed to all High Court and Supreme Court judges to take a stand against the unlawful activities of CJI Chandrachud and ensure that the principles of independence, impartiality, and fairness are upheld in the judiciary.
